TERMS OF USE (EULA)

1. Introduction

These Terms of Use (“Terms,” “Agreement”) govern your use of the Morprix AI Photo App (“App”), operated by Barawave (“we,” “our,” “us”).
By downloading, accessing, or using the App, you agree to these Terms.

If you do not agree, please do not use the App.

2. License Grant

We grant you a personal, revocable, non-exclusive, non-transferable license to use the App for personal and non-commercial purposes.

You may not:

  • copy, modify, reverse engineer, or decompile the App

  • resell, rent, or distribute the App

  • interfere with the App’s operation or security

  • bypass subscription or access controls

3. User Content

3.1 Ownership of Your Photos

You retain all rights and ownership over any photos or content you upload to the App (“User Content”).

3.2 Limited License for AI Processing

By uploading photos, you grant us a temporary license to use your images solely to:

  • generate AI-enhanced portraits

  • apply filters, styles, and morph effects

  • deliver features you explicitly request

This license ends automatically when processing is complete and your images are deleted.

3.3 No Use for Training or Advertising

We do not use your photos or content to:

  • train AI models

  • advertise our services

  • create facial recognition templates

  • perform identity matching

4. Prohibited User Content

You agree not to upload or generate content that:

  • violates any law or regulation

  • infringes copyright or intellectual property

  • contains explicit, violent, or hateful imagery

  • includes photos of others without consent

  • impersonates or harms others

  • contains malware or malicious scripts

We reserve the right to block or remove prohibited content.

5. Account Management

5.1 Account Responsibilities

You are responsible for:

  • maintaining control of your account

  • ensuring your credentials remain secure

  • all activity under your account

5.2 Account Deletion

You may delete your account at any time:
Settings → Account → Delete My Account

Deletion is permanent and removes all stored user data.

6. Subscriptions and Purchases

6.1 Morphix Pro Subscription

Some premium features require an auto-renewing subscription.

Subscription details are displayed in-app, including:

  • title

  • price

  • duration

  • renewal terms

6.2 Billing and Renewal

Billing is handled through Apple’s App Store.
Your subscription renews automatically unless canceled at least 24 hours before the end of the current period.

6.3 Managing Your Subscription

You can manage or cancel your subscription at:
Settings → Apple ID → Subscriptions

6.4 Refunds

Refunds are processed solely by Apple under their policies.

7. Intellectual Property

All App content, technology, functionality, and branding belong to Barawave or our licensors.
You may not reproduce or repurpose any part of the App outside of permitted use.

8. Acceptable Use Requirements

You may not:

  • attempt to disrupt or overload servers

  • use automated scripts, bots, or harvesting tools

  • use output for harmful, defamatory, or illegal purposes

  • commercially exploit AI outputs without explicit permission

9. AI-Generated Outputs

AI-generated images may not always be accurate or free of artifacts.
By using the App, you acknowledge that:

  • AI results may vary

  • AI may produce unexpected or imperfect outputs

  • Outputs are provided “as is”

You assume responsibility for how you use AI-generated images.

10. Disclaimer of Warranties

The App is provided “as is” without any warranties—express or implied—including:

  • fitness for a particular purpose

  • merchantability

  • non-infringement

  • error-free or uninterrupted performance

We do not guarantee that:

  • the App will always work without interruption

  • AI processing will be flawless

  • the App will meet your expectations

11. Limitation of Liability

To the maximum extent permitted by law:

  • We are not liable for lost data, revenue, or damages resulting from the use or inability to use the App.

  • You use the App at your own risk.

  • Our total liability shall not exceed the amount you paid for the App or subscription, if any.

12. Termination

We may suspend or terminate your access if you:

  • violate these Terms

  • misuse the App

  • upload prohibited content

You may stop using the App at any time.

13. Changes to These Terms

We may update or modify these Terms from time to time.
Updates will be posted with a new “Last Updated” date.
Continued use of the App constitutes acceptance of updated Terms.

14. Governing Law

These Terms are governed by and construed under applicable laws in your country or region, without regard to conflict-of-law principles.
